Parties
This Variation Agreement is made between the following parties:
- The Commonwealth of Australia as represented by the Minister for Families, Housing, Community Services and Indigenous Affairs (the Commonwealth)
- The State of New South Wales as represented by the Minister for Disability Services (New South Wales)
- The State of Victoria as represented by the Minister for Community Services (Victoria)
- The State of Queensland as represented by the Minister for Disability Services (Queensland)
- The State of Western Australia as represented by the Minister for Disability Services (Western Australia)
- The State of South Australia as represented by the Minister for Disability (South Australia)
- The State of Tasmania as represented by the Minister for Health and Human Services (Tasmania)
- The Australian Capital Territory as represented by the Minister for Disability and Community Services (Australian Capital Territory)
- The Northern Territory as represented by the Minister for Family and Community Services (Northern Territory)

Context

This Variation Agreement varies the Commonwealth State/Territory Disability Agreement (CSTDA) commencing 1 July 2002 and all bilateral agreements entered into under the CSTDA between the Commonwealth and each State or Territory (Bilateral Agreements).

The current CSTDA, known as CSTDA 3, is the third of the CSTDA agreements. CSTDA 3 builds on the earlier CSTDA 2 and sets five key policy priorities. These policy priorities are to:

strengthen access to generic services for people with disabilities;

strengthen across government linkages;
-
strengthen individuals, families and carers;
-
improve long-term strategies to respond to and manage demand for specialist disability services; and

improve accountability, performance reporting and quality.

The CSTDA agreement framework consists of a two-tiered arrangement of a multilateral agreement between the Parties and Bilateral Agreements between the Commonwealth and each State and Territory. The Bilateral Agreements are the:

CSTDA Bilateral Agreement developed as part of CSTDA 3;

increased Access to Respite Care for Older Carers Bilateral Agreement; and
-
Transfer of Services Bilateral Agreement for those States and Territories that have signed that Bilateral Agreement.

Each Party to this Variation Agreement entered into two earlier variation agreements (the First and Second Variations) that were signed individually between the Commonwealth and each State and Territory. The purpose of each of these individually signed agreements forming the First and Second Variations was to, amongst other things, extend the term of CSTDA3 and the Bilateral Agreements to 31 December 2007 and 30 June 2008 respectively. The Parties confirm their intention that both Variations signed separately by each State and Territory should operate to amend the multi-party CSTDA3 and Bilateral Agreements as described in those Variations.

The purpose of this Variation Agreement is to:
-
extend the term of CSTDA 3 until a new Disability Agreement is negotiated between the Parties;

ensure that funding continues under the extended CSTDA 3; and
-
extend the term of the Bilateral Agreements.

It is the intention of the Parties to:
-
negotiate the new Disability Agreement prior to the expiry of the extension of the term of CSTDA 3 under this Variation Agreement; and
-
negotiate Bilateral Agreements under a new Disability Agreement to replace the Bilateral Agreements under CSTDA 3.
