SSAct Chapter 5 provides the methods for recovery of debts owed to the Commonwealth under the SSAct and under certain other Acts and schemes (as provided for by SSAct subsection 1222(1)(c)).
In Walker v SDSS (1995) 56 FCR 354 the Federal Court held that SSAct Chapter 5 is a complete code which sets out the EXCLUSIVE methods for the lawful recovery of benefits listed in SSAct subsection 1222(1).
Section 1230C lists the means by which the Commonwealth may recover a debt and SSAct subsection 1222(2) provides a useful table setting out the various methods of recovery that are available for different types of debts.
SSAct section 1230B provides for the overseas application of sections 1223, 1224, 1224AA, 1224AB, 1224AD, 1227, 1227A, 1227B, 1228, 1184F and 1184I.
